Wie issn das, wenn man keine Gema hat und das dann gespielt wird?

Das geht die Gema dann nichts an, obwohl sie trotzdem erst einmal das Recht hat, dafür trotzdem zu kassieren.

Man darf ja ausm Radio aufnehmen, dann würde mandie Radioaufnahme
ja quasi dann verteilen können?

Im privaten Kreis auf jeden Fall, da man ja weiß, woher die Aufnahme kommt. Ansonsten gilt: Gebrannte CDs können immer aus einer illegalen Quelle kommen, sprich Download (kein Mitschnitt) oder eine digitale Kopie (keine anlaoge Kopie)
Im Zweifelsfall hat man die Kopie natürlich selbst legal erzeugt und nicht von einem Bekannten bekommen!

Wie ist das überhaupt wenn man nicht Gema Geschützt ist, kann
man das dann kopieren wie man will?

Nein, siehe oben. Es gilt immer das Urheberrecht. Wobei Privatkopien vom Original immer erlaubt sind, sofern man dafür keine Software verwendet, die ein funktionierden! Kopierschutz aushebelt.
Analoge Kopien und Mitschnitte sind immer erlaubt.
